1. GENERAL PROVISIONS
These general conditions of sale (hereinafter, "General Conditions") apply to all sales of products (hereinafter, "Products" or "Product") purchased through the website http://lcicosmetics.com/ (of hereinafter, "Site").
The language available to conclude the contract is Italian.
The Customer is required to carefully read the General Conditions which have been made available to him on the Site, in order to allow them to be stored and reproduced by the Customer pursuant to art. 12 of Legislative Decree 9 April 2003, n. 70.
The contracts concluded with Cerwo s.r.l.s. (as defined below) through the Site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, n. 206 ("Consumer Code") and by Legislative Decree 9 April 2003, n. 70 (hereinafter, "Ecommerce Decree").
2. SELLER IDENTIFICATION
The seller is CERWO s.r.l.s. (simplified limited liability company), with registered office in Ruffano (73049-LE), – Via Vittorio Emanuele 138 (FAX: 0833 1934386 TEL: 0833 691248 email: info@cerwo.com ) which ALSO uses for the marketing of LCI products, in charge of the sale provided with an identification card.
3. PRODUCT INFORMATION
The information relating to the LCI Products that can be sold by an agent is available in the LCI catalog shown by the agent or at the Link [www-LCICOSMETICS.com].
Delivered products may differ in package appearance from those shown by you or reproduced in LCI catalogs.
3.1. Cerwo srl, through the Website, remotely sells cosmetic products and equipment for nail care, including specialist products intended for professional use only and not available to the public (hereinafter, Products for brevity). Products intended for professional use only may be purchased only by customers who declare under their sole responsibility that they are professional customers in the aesthetic sector or podiatrists, or that they use the Products under the supervision and control of a professional in the aesthetic sector or podiatrist (professional pedicure products).
3.2. It is understood that, in any case, the Products cannot be destined by the Customers for sale/resale to third parties, unless expressly authorized by Cerwo srl.
4. PRICE
The prices of the products are inclusive of all taxes and duties, excluding delivery costs. Delivery costs will be specified on the order note at the time of signing the same depending on the quantity and type of goods purchased.
5. ORDER OF PRODUCTS
The essential characteristics and prices of the Products are shown in the offer relating to each Product.
For the purchase of the Products, the Customer must complete and send to Cerwo s.r.l.s. the order form in electronic format, following the instructions contained on the Site. The Customer must place the Product in the appropriate "cart" and, after having read the General Conditions, with particular reference to delivery costs and operating methods of the right of withdrawal, and the Privacy Policy, must select the desired payment method and choose the "proceed" option.
Before submitting the purchase order, the Customer will have the opportunity to correct any data entry errors by following the appropriate modification procedure contained on the Site. In particular, the Customer has the right to change the quantity of Products he intends to purchase, adding or deleting one or more Products from the "cart".
By sending the order, the Customer acknowledges and declares having read all the information provided during the purchase procedure and fully accepting the General Conditions.
6. ACCEPTANCE
Cerwo s.r.l.s. reserves the right to evaluate the acceptance of the orders received. Cerwo s.r.l.s. will inform the Customer of any impossibility to accept the orders received within 30 days starting from the day following the day on which the Customer sent the order to Cerwo s.r.l.s. and will refund any sums already paid by the Customer for the payment of the supply.
7. METHOD OF PAYMENT
The Customer may pay the price of the Products and the relative delivery costs by credit card, bank transfer or other means expressly approved by Cerwo S.r.l.s. within three days of signing the order note, or by cash on delivery upon receipt of the products.
The bank transfer payment must indicate the order note number as reason.
Any bank charges incurred by the customer for payments made by bank transfer will be charged to the customer.
The persons in charge of the sale are in no case authorized to receive payment for the products ordered by the Customer and any payments made directly to the persons in charge will not oblige CERWO s.r.l.s. in any way.
- METHOD OF PAYMENT WITH SCALAPAY
If you buy with Scalapay, you receive your order immediately and pay in 3 installments. You acknowledge that the installments will be transferred to Incremento SPV S.r.l., related parties and their assignees, and that you authorize this transfer.
8. TRANSPORT AND DELIVERY AND DELIVERY COSTS
The Products requested and paid for by credit card or by bank transfer will be delivered to the customer only after acceptance of the transaction by the bank and within 25 days of the aforementioned acceptance, while products paid for with cash on delivery will be delivered to the address indicated by the Customer within 30 days from the day following the signing of the order note.
The products will be delivered to the address indicated by the Customer by carrier during working days.
At the end of the delivery term, the products will be considered delivered within this term if the customer has material availability or in any case control of the ordered products.
At the time of delivery, the signature of an adult over the age of 18 will be required. No deliveries will be made to PO boxes.
The invoice/receipt of the products will be sent together with the delivered products.
Delivery costs are charged to the Customer and are clearly highlighted on the order note.
The Customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the package is intact or unaltered. Any damage to the package and/or the Products or the mismatch in the number of packages must be immediately notified by means of a written control reserve on the proof of delivery. If the delivery does not take place according to the contractual terms, the customer must invite CERWO s.r.l.s. to carry out the delivery within an additional period of five days and if even within this period the products are not delivered, the Customer is entitled to terminate the contract without prejudice to the right to compensation for damages.
9. RIGHT OF WITHDRAWAL AND RETURN OF PRODUCTS
The customer always has the right of withdrawal up to the 14th day following the delivery of the products (the right can be exercised even before the delivery of the ordered products) without having to specify the reason for the withdrawal.
The right of withdrawal must be exercised with a written communication to be sent to CERWO s.r.l.s., indicating the number of the order note (possibly also making use of the withdrawal form delivered to the customer) and specifying whether the right is exercised on all products or only on some products ordered, at the following telephone number [ 0833 691248 ] or at the email address: info@cerwo.com or by return receipt: CERWO S.r.l.s. - Via Vittorio Emanuele 138 - 73049 Ruffano (LE) Att. The right of withdrawal, if the customer has already received the products, can also be exercised by returning the products received in their intact packaging or those for which you wish to exercise the right of withdrawal at your own expense, to

In any case, when the right of withdrawal is exercised, the products, if received by the Customer, must be returned by the same within 14 days from the date of communication to CERWO s.r.l.s. of the decision to withdraw from the contract (the deadline is considered respected if the Customer sends back the goods before the fourteen-day period has expired).
The cost of returning the goods to CERWO s.r.l.s. is charged to the customer.
10.RETURN OF THE SUMS PAID IN THE EVENT OF WITHDRAWAL
In case of exercise of the right of withdrawal, CERWO s.r.l.s. will refund in full the price paid for the Products by the Customer provided that these are returned by the Customer in intact and untampered packages.
If the product is not tampered with and returned in its sealed packaging, CERWO s.r.l.s. will refund only the products received intact in addition to the shipping costs resulting from the order note.
Refunds will be made by canceling the charge on the credit card if still possible or by returning the sum by bank transfer to the current account indicated by the Customer in the order note.
CERWO s.r.l.s. will refund the sums due to the customer within fourteen days of being informed of the intention to withdraw, if the products have not yet been delivered, or within fourteen days of receiving the return of the goods or of the day the Customer has demonstrated that you have returned the goods.
11. APPLICABLE LAW AND JURISDICTION
These General Conditions are governed by Italian law and must be interpreted in accordance with Italian laws. For disputes arising from the interpretation, validity and/or execution of these General Conditions, the territorial jurisdiction is that of the customer's residence or domicile if in Italy.
